Who we are

ModernMortgages.ca is the website of Theeban Pathmanathan, Mortgage Agent Level 2 (FSRA licence #M14000189), who arranges mortgages through FIN Mortgage – Dominion Lending Centres (Brokerage Licence #12825, independently owned and operated). In this policy, "I", "we" and "us" mean Theeban Pathmanathan and the brokerage when acting on your mortgage file. We follow Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and the privacy obligations that apply to mortgage brokerages and agents in Ontario.

What we collect

• Contact details such as your name, phone number, email address and mailing address.
• Information for a mortgage application, including date of birth, employment and income, assets and debts, property details, government-issued identification and, with your consent, your credit report.
• Booking details you enter when you schedule a call, such as your name, contact details, preferred time and any notes.
• Giveaway entries submitted through the VIP Club registration form.
• Basic technical data such as browser type, pages visited, buttons clicked and approximate location, only if you accept analytics cookies.

Please do not send your Social Insurance Number, banking passwords or full identity documents by text, WhatsApp or social media messages. If a lender needs a document, we will tell you how to send it securely.

How we collect it

Booking a call

The "Book a Free Call" buttons open an online scheduling page provided by a third-party calendar service (currently Google Calendar appointment scheduling). The details you enter are stored by that provider and shared with me so I can confirm and prepare for your call. The provider's own privacy policy also applies.

Applying online

The "Apply Now" buttons open a secure mortgage application hosted on Velocity, a mortgage application platform by Newton, used by the brokerage. Information you enter there is stored on that platform and used to assess your application and submit it to lenders you authorise. The platform's privacy terms also apply.

VIP Club giveaway

The VIP Club monthly giveaway registration on our links page uses a Google Forms form. We use the details you submit to run the giveaway, contact entrants and winners and, only if you agree, send you occasional updates. Entry details are stored by Google on our behalf.

Phone, text, WhatsApp and social media

If you call, text or message us, we keep the information you share so we can respond and work on your file. WhatsApp and social networks are run by third parties with their own privacy practices.

Why we use it

• To answer your questions, schedule calls and give you mortgage advice.
• To assess your application, obtain your credit report with consent, and submit your application to lenders and, where needed, mortgage default insurers.
• To verify your identity and meet our legal, regulatory and record-keeping obligations, including those set by the Financial Services Regulatory Authority of Ontario (FSRA) and federal anti-money-laundering rules.
• To service your mortgage after closing, such as renewal reminders, if you agree.
• To run the VIP Club giveaway.
• To understand how the website is used and improve it, if you accept analytics cookies.

We only send marketing emails or texts with your consent, as required by Canada's Anti-Spam Legislation (CASL), and you can unsubscribe at any time.

Consent

We ask for your consent before collecting, using or sharing your personal information, except where the law allows otherwise. Submitting an application or booking a call means you consent to the uses described above for that purpose. You can withdraw consent at any time, subject to legal or contractual limits, but this may mean we cannot continue working on your mortgage.

Who we share it with

We share personal information only as needed for the purposes above, with:

• The brokerage, FIN Mortgage – Dominion Lending Centres, and its compliance and administrative staff.
• Lenders you choose to apply with, and mortgage default insurers where insurance is required.
• Credit bureaus, appraisers, lawyers and title insurers involved in your file.
• Service providers that host our tools (scheduling, application platform, forms, email and website hosting), under appropriate safeguards.
• Regulators or law enforcement, when required by law.

We do not sell your personal information. Some providers may store information outside Canada, where it may be subject to the laws of that country.

Cookies and analytics

This website uses Google Analytics 4, provided by Google, to count visits and understand which pages and buttons (such as Book, Apply, Call, WhatsApp and Email) are used. Google Analytics only loads, and only sets its cookies, after you click "Accept" in the cookie banner. Until then, and if you click "Decline", no analytics cookies are set and no analytics data is sent. We use Google's Consent Mode with advertising storage and ad personalisation always turned off, and we do not use Google Analytics for advertising.

Your choice is saved in your browser's local storage so we don't ask again on every visit. You can change it at any time with the "Cookie settings" link in the footer, or by clearing your browser's site data. Google Analytics data is processed by Google, which may store it outside Canada; see Google's privacy policy. The site sets no other cookies of its own.

How we protect and keep it

We use reasonable physical, organisational and technical safeguards, including secure platforms for applications and documents and limited access to client files. We keep personal information only as long as needed for the purposes above and to meet legal and regulatory record-keeping requirements, then destroy or anonymise it securely.

Your rights

You can ask to see the personal information we hold about you, ask how it has been used and shared, and ask us to correct anything that is inaccurate. We will respond within the time limits set by law. We may need to confirm your identity first.
